On Monday, June 2, 2025, the Arizona Supreme Court reinstated attorney William P. Fay as an active member of the State Bar of Arizona.

The case is entitled “In the Matter of William P. Fay,” with case number SB-25-0032-R.

Fay, who had been administratively suspended since June 25, 2019, for nonpayment of dues, successfully applied for reinstatement earlier this year. The court’s decision followed a recommendation from the Presiding Disciplinary Judge, who approved an Agreement for Reinstatement submitted by Fay and the State Bar on May 1, 2025.

Fay’s application for reinstatement, filed on February 13, 2025, met all requirements outlined in Arizona Supreme Court Rule 65(a)(1). The agreement, supported by stipulated facts, conclusions of law, and exhibits, confirmed that Fay is competent, fit to practice law, and has complied with all disciplinary rules. Notably, the State Bar and Fay agreed to waive the requirement for him to retake the Arizona bar examination, a decision the Presiding Disciplinary Judge, Lisa A. VandenBerg, endorsed in her May 6, 2025, recommendation to the Supreme Court.

The waiver was based on Fay’s professional activities during his suspension. Since 2019, he has served as an Engineer Administrator for the Arizona Department of Transportation, a role involving significant legal responsibilities such as contract review and application of rules. Fay also monitors litigation and claims for the department, excluding general tort liability cases.

Additionally, he has engaged in law-related education, presenting seminars on topics like Buy America Build America regulations and construction delay claims. Fay has provided pro bono representation for veterans seeking VA benefits, participated in his community’s Planning and Zoning Commission, and been involved in children’s advocacy, all of which demonstrate his ongoing engagement with legal matters.

The Arizona Supreme Court, after reviewing the recommendation, issued an order reinstating Fay effective June 2, 2025, and sealed his tax returns.
