On Thursday, December 7, 2023, the Presiding Disciplinary Judge of the Arizona Supreme Court affirmed the disbarment of Attorney Elvin Garry Grundy, III after no timely appeal was filed against the Decision and Order Imposing Sanctions rendered by the Arizona Bar hearing panel on November 16, 2023.

Attorney Elvin Grundy’s violations with the State Bar of Arizona span several years of various issues related to client representation and misconduct. In 2023, several new complaints were opened against him that would prove to be the final straw.

Attorney Grundy was summarily suspended on June 13, 2023, for failing to pay his annual membership fees to the State Bar of Arizona as required. Despite receiving notice of his suspension, Grundy continued to represent clients in several ongoing legal matters.

On September 21, 2023, a formal complaint was filed against Attorney Grundy by the State Bar, regarding four counts of misconduct. The complaint alleged Attorney Grundy failed to transfer client files properly, comply with court orders, respond to requests from the State Bar, and withdraw from legal cases as required after his suspension.

As Grundy did not file an answer to the complaint, a default was entered against him on October 30, 2023. A hearing was held on November 16th to determine sanctions. Due to his unexcused absence, the factual allegations against Attorney Grundy were deemed admitted.

In its decision, the hearing panel found Attorney Grundy violated numerous Rules of Professional Conduct and Ethics rules. He was found to have caused actual harm to clients who were deprived of counsel and potential harm to the legal system. The panel described Grundy’s misconduct as “egregious” and noted his prior disciplinary offenses and failure to cooperate as aggravating factors.

Disbarment was imposed effective immediately. Attorney Grundy was also ordered to pay costs incurred by the State Bar totaling $2,072.52. On December 7, 2023, Presiding Disciplinary Judge Margaret Downie affirmed the disbarment and ordered Grundy to comply with client notification requirements.

“The hearing panel rendered its Decision and Order Imposing Sanctions on November 16, 2023. No timely appeal was filed.

IT IS ORDERED affirming the disbarment of ELVIN GARRY GRUNDY, III, BarNo. 027545, effective November 16, 2023.”
