On November 9, 2023, the Arkansas Supreme Court Committee on Professional Conduct reprimanded Attorney Monica Lee Mason following formal charges of misconduct related to Mason’s representation in a probate matter.

The case is entitled “In the Matter of Monica Lee Mason” with case number CPC-2023-007.

The charge violated the Arkansas Supreme Court Committee on Professional Conduct Rules 1.3 and 1.4(a)(3), which:

Requires that a lawyer shall keep the client reasonably informed about the status of the matter

Requires that a lawyer shall promptly comply with reasonable requests for information.

The charges of misconduct stem from information provided by Xaniah Turner Conley on January 18, 2023, regarding Mason’s representation of Conley in a probate matter.

Conley, the granddaughter of the decedent Willie H. Turner, initially contacted Mason on October 13, 2022, seeking representation in Lonoke County Circuit Court, Case No. 43PR-21-147. Conley, a minor at the time, paid Mason $2,500.00 for the representation.

Mason promptly drafted necessary legal documents and sent them to Conley, who executed and returned them via Priority U.S. Mail on October 17, 2022. However, Mason subsequently failed to file these documents with the court, ignored Conley’s attempts at contact, and did not provide updates on the probate matter.

Based on these actions, the Committee found Mason in violation of the aforementioned Rules of the Arkansas Rules of Professional Conduct. As a result, Mason is reprimanded for her conduct, fined $5,000.00, ordered to pay costs of $150.00, and directed to provide restitution to Conley in the amount of $2,500.00.

The total amount due, including the fine, costs, and restitution, is $7,650.00, payable within thirty days to the Office of Professional Conduct. The Findings and Order are effective upon filing with the Clerk of the Arkansas Supreme Court.

According to Martindale, Ms. Mason is practicing in Sherwood, Arkansas. She attended the University of Arkansas at Little Rock, graduating in 1998. She acquired her law license in Arkansas the same year.
