On Thursday, April 24, 2025, the New York Supreme Court, Appellate Division, Third Judicial Department granted the application of attorney Abigail Helen Hornsby to resign from the New York Bar for nondisciplinary reasons. Hornsby had requested permission to resign through an affidavit sworn on January 17, 2025.

The case is entitled “In the Matter of Abigail Helen Hornsby,” with case no. PM-99-25.

The Attorney Grievance Committee for the Third Judicial Department opposed Hornsby’s application, arguing that she was ineligible for a nondisciplinary resignation due to her failure to meet attorney registration requirements for the 2024-2025 biennial period. However, in response to this opposition, Hornsby swore a supplemental affidavit on April 4, 2025, indicating that she had rectified her registration status and was now in compliance with all requirements.

The Office of Court Administration confirmed that Hornsby had duly registered and resolved any prior registration issues. With no further substantive objections from the Attorney Grievance Committee, the court found that Hornsby was eligible to resign without disciplinary action.

The court’s decision includes several directives. Hornsby’s name will be removed from the roll of attorneys and counselors-at-law in New York effective immediately. She is also ordered to refrain from practicing law in any capacity within the state, including as an agent, clerk, or employee of another attorney. Additionally, Hornsby is prohibited from appearing in any legal capacity before courts or public authorities and must not provide legal opinions or advice.

Hornsby is required to surrender any Attorney Secure Pass issued to her to the Office of Court Administration within 30 days of the decision.

The Disposition states:

“ORDERED that Abigail Helen Hornsby’s application for permission to resign is granted and her nondisciplinary resignation is accepted.”

According to the filing, Ms. Hornsby acquired her law license in New York in 2022.
