On Thursday, July 24, 2025, the Supreme Court of the State of New York, Appellate Division, First Judicial Department granted a joint motion for discipline by consent, publicly censuring attorney Alan Mark Weintraub. The decision followed disciplinary proceedings initiated by the Attorney Grievance Committee (AGC) for the First Judicial Department, stemming from Weintraub’s criminal conviction.

The case is entitled “In the Matter of Alan Mark Weintraub,” with case number 2024-03858.

On April 24, 2023, Weintraub pleaded guilty in the Criminal Court of the City of New York to possession of usurious loan records, a class A misdemeanor under Penal Law § 190.45. The conviction related to his involvement in a usurious loan operation, specifically for possessing a document listing individuals and their owed amounts. He was sentenced to a one-year conditional discharge and fined $1,000.

Following his conviction, Weintraub promptly notified the AGC. On June 18, 2024, the AGC filed a petition alleging misconduct under rules 8.4(b) and 8.4(h) of the New York Rules of Professional Conduct. Weintraub denied the charges in his July 14, 2024, response. On June 2, 2025, the AGC and Weintraub submitted a joint motion requesting public censure as the appropriate discipline.

The motion highlighted several mitigating factors: Weintraub’s lack of prior disciplinary history, full cooperation with the criminal justice system, acceptance of responsibility, and expressed remorse. It also noted that the misconduct did not involve the misuse or misappropriation of client funds or unjust enrichment. The parties cited prior cases, including those involving attorneys disciplined with public censure for similar misdemeanors, to support the proposed sanction.

The court, presided over by Justice Peter H. Moulton and joined by Justices Tanya R. Kennedy, David Friedman, Lizbeth González, and Manuel J. Mendez, found the joint motion appropriate. The unanimous decision imposed a public censure on Weintraub, concluding the disciplinary proceedings.

According to Avvo, Mr. Weintraub is a lawyer in New York, NY. He acquired his law license in New York in 1983.
