The disciplinary action requires Nichols to demonstrate clear and convincing evidence of rehabilitation, compliance with all disciplinary orders and rules, and fitness to practice law before reinstatement. Nichols’ suspension took effect immediately on the same day.

The disciplinary measures stem from multiple instances of misconduct. In one instance, Nichols neglected a client matter involving a homeowner’s association (HOA), failing to take action after filing a complaint and not responding to the defendant’s calls, leading to the case’s closure.

In a separate case, the court questioned the timeliness of a response filed by a defendant, initially entering default based on Nichols’ representation. Nichols then failed to attend a case management conference, resulting in the case’s dismissal with prejudice. Subsequent counsel for the HOA attempted to reverse the dismissal, citing communication issues with Nichols, but the motion was denied.

Furthermore, Nichols mishandled funds in another HOA case. While the defendants paid Nichols $3,509.30, she only remitted $1,617.20 to the HOA, leaving a balance of $1,892.10. Her trust account dipped below this balance, preventing her from tendering the full amount to the HOA until later.

These actions constitute violations of multiple Colorado Rules of Professional Conduct, including rules related to diligence and promptness, client communication, safeguarding client property, protecting client interests upon termination of representation, and engaging in conduct involving dishonesty, fraud, deceit, or misrepresentation, as well as conduct prejudicial to the administration of justice.
