On Tuesday, December 5, 2023, the Iowa Supreme Court issued an order publicly reprimanding attorney Cody Mark Kiroff for misconduct that occurred while his law license was under suspension.

The case is entitled “Iowa Supreme Court Attorney Disciplinary Board v. Cody Mark Kiroff,” with case no. 23-1840.

According to the filing, Kiroff was initially suspended from practicing law in Iowa on September 5, 2019, for failure to comply with continuing legal education requirements. He was later reinstated on May 11, 2021. However, Kiroff’s license was again suspended on September 26, 2022, for the same reason.

While suspended, the Iowa Supreme Court Attorney Disciplinary Board alleged that Kiroff continued to practice law without a valid license. Kiroff was working as corporate counsel for W.R. Berkley Corporation in Davenport, Iowa, and providing legal services related to contracts, data privacy, and cybersecurity matters.

Documents showed that Kiroff held himself out publicly as an attorney through his online LinkedIn profile and told his employer he was licensed to practice law in Illinois, though records indicated his registration there had lapsed in 2019.

On January 17, 2023, the Attorney Disciplinary Board opened a formal complaint against Kiroff and investigated his unauthorized practice of law during suspension. Though Kiroff disputed the allegations, he was eventually personally served with the complaint in April 2023.

In its September 1st, 2023 letter of public reprimand, the board noted Kiroff’s misconduct was an “aggravating factor” given it was his second suspension and he had avoided cooperating with the disciplinary investigation. The board concluded that Kiroff’s job duties at W.R. Berkley constituted the practice of law under Iowa law. His license reinstatement in February 2023 came after initially challenging the service of the disciplinary complaint.

On December 5th, 2023, the Iowa Supreme Court issued its order making Kiroff’s public reprimand part of the official court record.

The Disposition states:

“Pursuant to Iowa Court Rule 35.12, the Iowa Supreme Court Attorney Disciplinary Board reprimand of attorney Cody Mark Kiroff, Davenport, Iowa, has been filed with the clerk of this court with proof of service and a statement that Kiroff has not filed an exception within the time prescribed. The court orders that the reprimand of Cody Mark Kiroffbe included in the records of this court as a public document.”

According to avvo.com, Mr. Kiroff is a litigation attorney in Davenport, Iowa. He acquired his law license in Iowa in 2011.
