On Thursday, January 18, 2024, the Appellate Division of the Supreme Court of New York in the First Judicial Department disbarred attorney David Alan Tessler.
The case is entitled “In the Matter of David Alan Tessler,” with case no. 2024 NY Slip Op 00232.
Tessler was initially suspended from practice on April 11, 2023, due to his failure to cooperate with the Attorney Grievance Committee’s investigation into complaints filed against him. Specifically, Tessler did not answer two client complaints, failed to appear for a deposition under subpoena, and failed to register as an attorney for 2021-2022.
Following his suspension, Tessler was required to respond to or cooperate with further investigatory or disciplinary proceedings within six months. However, he did not make any contact with the Attorney Grievance Committee or the court during that time period.
As a result, on October 25, 2023, the Attorney Grievance Committee filed a motion to disbar Tessler based on the rules allowing the disbarment of attorneys who fail to respond to charges leading to their suspension within six months. Tessler was personally served with the disbarment motion at the last registered address he provided but did not file any response.
On January 18, 2024, the Appellate Division granted the disbarment motion. Tessler is now prohibited from practicing law in New York state. He must also formally cease holding himself out as an attorney and is subject to rules governing the conduct of disbarred lawyers. Tessler’s name will be stricken from the roll of attorneys admitted to practice in New York.
The Disposition states:
“It is Ordered that the motion by the Attorney Grievance Committee for the First Judicial Department for an order pursuant to 22 NYCRR 1240.9(b) disbarring respondent, David Alan Tessler, is granted, and the respondent is disbarred, effective the date hereof, and his name is stricken from the roll of attorneys and counselors-at-law in the State of New York,”
According to avvo.com, Mr. Tessler was a medical malpractice attorney in New York, New York. He attended the Fordham University School of Law. He acquired his law license in New York in 1993.
