On Thursday, March 23, 2023, the New York Supreme Court Appellate Division Third Judicial Department ruled on the petition for reinstatement filed by England attorney Diane Nhi Tran.
According to the Decision and Order on Motion, Tran was suspended from practice by a September 2022 order of the Court for violation of the Judiciary Law §468-a, which requires every attorney admitted to practice in the State of New York to register every two years with the Chief Administrator of the Courts.
Tran sought reinstatement by filing a notice of motion and affidavit with exhibits sworn on November 2, 2022, to which the Attorney Grievance Committee made no objection.
The court, on the other hand, stated that Tran has provided clear and convincing evidence that she has complied with the order of suspension and the court rules, that she is fit to practice law, and that her reinstatement would be in the public interest, and thereby ruled in favor of Tran.
The disposition reads:
“ORDERED that respondent’s motion for reinstatement is granted; and it is further
ORDERED that respondent is reinstated as an attorney and counselor-at-law in the State of New York. effective immediately.”
