On Thursday, June 1, 2023, the State of New York Supreme Court, Appellate Division Third Judicial Department granted the motion for reinstatement of attorney Douglas Robert Schwartz.

After carefully reviewing the respondent’s motion and the accompanying affidavit, which was sworn to on September 13, 2022, along with the provided exhibits, as well as considering the correspondence from the Attorney Grievance Committee for the Third Judicial Department dated February 23, 2023, the court has determined, based on clear and convincing evidence, the following: (1) the respondent has adhered to the suspension order and has complied with the court’s rules, (2) the respondent possesses the necessary character and fitness required for the practice of law, and (3) reinstating the respondent would serve the public interest. These findings align with the precedent set in the case of Matter of Boericke, 214 AD3d 12441, 1244 [3d Dept 2023].
In light of the above considerations, the court granted the respondent’s motion for reinstatement.
The Disposition states:
“ORDERED that respondent’s motion for reinstatement is granted, and it is further ORDERED that respondent is reinstated as an attorney and counselor-at-law, effective immediately.”
