On Thursday, October 9, 2025, the Supreme Court of Indiana granted a joint petition to dismiss as moot a disciplinary case against Attorney General Theodore E. Rokita. The case, initiated by the Disciplinary Commission, stemmed from concerns that Rokita’s public statements following a previous disciplinary action contradicted his sworn acceptance of responsibility.
The case is entitled “In the Matter of Theodore E. Rokita,” with case no. 25S-DI-29.
The initial disciplinary action against Rokita (Case No. 23S-DI-258) concluded on November 2, 2023, with a public reprimand for admitted misconduct. However, the Disciplinary Commission filed a second complaint on January 31, 2025, alleging that Rokita’s subsequent public remarks cast doubt on the sincerity of his earlier acceptance of responsibility. The Supreme Court initially denied Rokita’s motion to dismiss this second complaint and appointed a panel of hearing officers.
The Court suggested that the parties attempt to resolve the dispute, resulting in a Conditional Agreement between the Parties and a Petition to Dismiss as Moot.
Rokita and the Disciplinary Commission jointly submitted a statement in which Rokita reaffirmed his acceptance of responsibility for violating the Indiana Rules of Professional Conduct, as stated in an affidavit executed on September 1, 2023. He further affirmed that he “really meant it” when he signed the affidavit accepting responsibility voluntarily, clarifying any confusion that may have resulted from his public statements after the November 2, 2023, discipline.
The Disciplinary Commission stated that this joint statement resolved the concerns raised by Rokita’s public statements. The Supreme Court, based on the agreement, granted the petition to dismiss the matter as moot and declined to assess any costs, as the parties agreed to bear their own expenses.
The appointed hearing officers were discharged, and the case was closed.
