On Wednesday, February 7, 2024, the Supreme Court of California issued an order disbarring Mark Alan Brifman from practicing law in the state. The order stemmed from a petition for disbarment filed against Brifman in August 2023 by the State Bar of California Office of Chief Trial Counsel.

The case is entitled “In the Matter of Mark Alan Brifman,” with case no. S282885.

According to the petition, Brifman failed to respond to initial disciplinary charges filed against him in February 2023. The charges alleged Brifman violated the Business and Professions Code and would warrant the imposition of discipline.

When Brifman did not file an answer to the initial charges within 20 days, as required, the State Bar filed for entry of default against him in April 2023. Brifman also failed to respond to this motion. In May 2023, the State Bar Court entered Brifman’s default, deeming the facts alleged in the disciplinary charges admitted.

Brifman did not file a motion within the required 90 days to set aside the default. As a result, the State Bar filed a petition for disbarment after default in August 2023. The petition argued all requirements for a mandatory disbarment recommendation under State Bar rules had been met since Brifman failed to participate in the proceedings and did not dispute the charges against him.

In its February 2024 order, the California Supreme Court adopted the disbarment recommendation. The order disbarred Brifman and struck his name from the roll of California attorneys. It also mandated he comply with notice requirements to clients and pay $5,000 in sanctions to the State Bar Client Security Fund.

Brifman had been disciplined three previous times dating back to 2013, according to the disbarment petition. His most recent suspension was for 60 days in 2022 involving misconduct related to performance, communication, and withdrawal from a client matter.

According to avvo.com, Mr. Brifman was a litigation attorney in Mission Hills, California. He attended the University of California at Los Angeles School of Law. He acquired his law license in California in 1977.
