Furthermore, he is required to refund any unearned fees and account for any trust funds he may possess.

To ensure compliance with these orders, Mariotti must file an affidavit with the court and disciplinary counsel, demonstrating that he has fulfilled all obligations outlined in the order. He is also responsible for maintaining records of his actions related to this process and keeping the court informed about any changes to his address.

The Disposition states:

“On consideration thereof, it is ordered by the court that pursuant to Gov.Bar R. VI(II)(C), the resignation as an attorney and counselor at law is accepted as a resignation with disciplinary action pending.”
