On Thursday, July 31, 2025, the New York Supreme Court, Appellate Division, First Judicial Department, granted the reinstatement of attorney Marnie Berk. This decision follows her suspension from practicing law due to non-compliance with Judiciary Law §468-a.

The case is entitled “In the Matter of Marnie Berk,” with case no. 2025-03581.

Surcan faced disciplinary action leading to her suspension, which took effect immediately following a court order on March 20, 2025. The suspension was a result of her failure to adhere to the requirements outlined in the aforementioned law.

In her motion for reinstatement, Surcan demonstrated compliance with the necessary legal obligations, achieving this by approximately May 20, 2025. The Attorney Grievance Committee for the First Judicial Department did not oppose her reinstatement.

The court reviewed the submitted documentation and, after due deliberation, found sufficient grounds to grant her request.

The ruling allows Surcan to resume her role as an attorney and counselor-at-law in the State of New York, effective immediately. The court’s order not only marks a significant relief for Surcan but also reaffirms the procedural adherence expected of members of the legal profession.
