On Thursday, May 29, 2025, The Florida Bar filed a complaint against attorney Matthew F. Herman in the Supreme Court of Florida, alleging misconduct in a Broward County legal case. Herman is accused of making false statements about a judge’s integrity with reckless disregard for their truthfulness, violating several rules governing attorney conduct.

The case is entitled “The Florida Bar v. Matthew F. Herman,” with case no. 2024-50,061(17J).

The complaint stems from a legal dispute, The Herman Law Group, P.A. v. Peter G. Herman, filed in Broward County Circuit Court, Case No. CACE-22004734. The Herman Law Group is made up of father Bruce Herman and his son Matthew Herman. The defendant in the case, Peter Herman, is Matthew’s uncle and Bruce’s brother. On July 19, 2023, Bruce and Matthew, representing their firm, filed a motion to disqualify Judge Carlos Rodriguez, alleging a decades-long personal friendship between the judge and Peter Herman. The motion claimed this relationship biased the judge against their firm.

The Florida Bar alleges that the motion contained false statements made with reckless disregard for their truth, including claims that Judge Rodriguez and Peter Herman played football together in high school and maintained a close friendship. Peter Herman denied these allegations in a sworn declaration, and Judge Rodriguez rejected the motion as legally insufficient. The judge then recused himself, citing false and spurious allegations in the motion, and referred the matter to the State Attorney’s office for investigation.

The Florida Bar asserts that Matthew Herman’s actions violated rules prohibiting false statements about a judge’s integrity and conduct prejudicial to the administration of justice. The complaint seeks disciplinary action against Matthew.

The Complaint states:

“WHEREFORE, The Florida Bar respectfully requests that this Court appropriately discipline the respondent under the Rules Regulating The Florida Bar.”

According to the filing, Mr. Herman acquired his law license in Florida in 2010.
