On Tuesday, January 14, 2025, the New York Supreme Court, Appellate Division, First Judicial Department granted a motion to reinstate attorney Michael Faillace to the New York Bar. Faillace, suspended from practicing law in 2022, will resume his legal career following the court’s decision.
The case is entitled “In the Matter of Michael Faillace,” with case no. 2022-01469.
Faillace’s suspension, which took effect on August 1, 2022, stemmed from disciplinary action imposed by the United States District Court for the Southern District of New York. This action, taken on November 8, 2021, initiated a reciprocal discipline process under which Faillace was barred from practicing law in New York.
On December 23, 2024, Faillace filed a motion seeking reinstatement as an attorney and counselor-at-law in New York. The motion was supported by the Lawyers’ Fund for Client Protection, which indicated in a letter dated October 21, 2024, that it had no objections to Faillace’s request for reinstatement. Additionally, the Attorney Grievance Committee, represented by Chief Attorney Jorge Dopico and counsel Kelly A. Lantham, submitted an affirmation on December 19, 2024, stating that the committee did not oppose the motion either.
After reviewing the submitted documents and conducting deliberations, the court decided to grant the motion. As a result, Faillace is now authorized to practice law in New York once again. The court has directed him to register immediately with the Office of Court Administration and to pay any applicable registration fees, in accordance with Judiciary Law § 468-a.
The Disposition states:
“Ordered that the motion is granted, and petitioner is reinstated as an attorney and counselor-at-law in the State of New York, effective the date hereof.”
