On Tuesday, February 4, 2025, the Board of Immigration Appeals suspended Attorney Steven Kreiss from practicing before the Board, the Immigration Courts, and the Department of Homeland Security (DHS) for one year, effective December 10, 2024. This decision follows a ruling by the District of Columbia Court of Appeals, which had ordered Kreiss’ suspension from the practice of law for one year, starting November 11, 2024, with reinstatement contingent upon demonstrating fitness to practice.

The case is entitled “In the Matter of Steven Kreiss.”

The suspension was prompted by Kreiss’s failure to respond to a Joint Notice of Intent to Discipline filed by the Disciplinary Counsel for both the Executive Office for Immigration Review and DHS. According to the regulations, his non-response constitutes an admission of the allegations, thereby barring him from requesting a hearing on the matter.

The Board’s order emphasized the appropriateness of the suspension in light of Kreiss’s existing suspension in the District of Columbia. The order also mandates that Kreiss must adhere to the directives outlined in previous rulings, including notifying the Board of any subsequent disciplinary actions against him.

Additionally, the contents of the order will be made public, including access to Immigration Courts and relevant DHS offices. Kreiss retains the right to petition for reinstatement to practice before the Board, the Immigration Courts, and DHS as outlined in the applicable regulations.
