On Thursday, March 23, 2023, the State of New York, Supreme Court, Appellate Division, Third Judicial Department, entered a Decision and Order on Motion accepting attorney Sue-Ellen Cassiana Fernandes’ petition for reinstatement.

The case is entitled “In the Matter of Sue-Ellen Cassiana Fernandes,” with case no. PM-62-23.

On October 2021, an order from the court was issued suspending attorney Fernandes’ license to practice law in New York. Following the suspension, attorney Fernandes filed a motion for an order reinstating him.

In relation to the petition, attorney Fernandes filed a respondent’s notice of motion and affidavit with exhibits sworn on November 12, 2022, before the Supreme Court of New York. On the other hand, on December 19, 2022, the Attorney Grievance Committee for the third judicial department filed a correspondence determining by clear and convincing evidence that the respondent has complied with the order of suspension and the rules of the court. Second, the respondent has the requisite character and fitness to practice law. Lastly, it would be in the public interest to reinstate the respondent to the practice of law.

Having considered the sworn affidavit filed by the respondent and the correspondence from the AGC agreeing with the petition, the court decided to grant the petition.

The order states:

“ORDERED that respondent’s motion for reinstatement is granted; and it is further ORDERED that respondent is reinstated as an attorney and counselor-at-law, effective immediately.”
