On Thursday, December 19, 2025, the Board of Immigration Appeals disbarred attorney Vy Thuan Nguyen from practicing before the Board, the Immigration Courts, and the Department of Homeland Security (DHS).
The case is entitled “In the Matter of Vy Thuan Nguyen.”
The disbarment follows a series of disciplinary actions initiated by the State Bar of Texas, where Nguyen was disbarred from practicing law effective May 10, 2024. Subsequently, on October 31, 2024, the Disciplinary Counsel for both the Executive Office for Immigration Review and the DHS filed a joint petition requesting Nguyen’s immediate suspension. The Board granted this petition, leading to the suspension that also served as the basis for the disbarment.
Nguyen was required to respond to the allegations outlined in a Joint Notice of Intent to Discipline but failed to submit a timely answer. According to the regulations, this lack of response is deemed an admission of the allegations, which precludes her from requesting a hearing.
The Joint Notice proposed that Nguyen be disbarred from practice before the Board, the Immigration Courts, and DHS, effective from the date of the immediate suspension. Given Nguyen’s disbarment in Texas and her failure to respond to the disciplinary proceedings, the Board determined that the proposed sanction was appropriate and warranted.
In addition to the disbarment, the Board issued further orders requiring Nguyen to comply with directives from the November 14, 2024, immediate suspension order. She is also mandated to notify the Board of any additional disciplinary actions taken against her.
The Dispositin states:
“The Board hereby disbars the respondent from practice before the Board, the Immigration Courts, and DHS, effective November 14, 2024.”
