On Thursday, July 14, 2023, the Supreme Court of Pennsylvania ordered the temporary suspension of attorney Yale Darran Weinstein for her financial improprieties relating to IOLTA account.
The case is entitled “Office of Disciplinary Counsel v. Yale Darran Weinstein” with case no. 95 DB 2023.
On June 29, 2023, the Office of Disciplinary Counsel (ODC) filed a joint petition seeking an emergency temporary suspension against Weinstein. This petition was made in response to alleged misconduct or violations of professional conduct rules by Weinstein, warranting an urgent measure to protect the interests of the public and the integrity of the legal profession.
The filing states:
“On June 21, 2023, ODC opened File No. C2-23-566 against respondent based on a letter submitted on his behalf by his attorneys wherein Respondent “acknowledge[d] improprieties regarding the IOLTA account for his law firm, Burton Neil & Associates” and communicated “his cooperation in an anticipated Disciplinary Board investigation.’”
The respondent is currently under criminal investigation by the West Goshen Police Department for financial improprieties relating to his IOLTA account. The filing continues:
“WHEREFORE, ODC and Respondent jointly move your Honorable Court to enter an Order temporarily suspending Respondent from the practice of law pursuant to Pa.R.D.E. 208(f) until further definitive action by the Court.”
Both the Office of the Disciplinary Counsel and Weinstein agreed that it is in the best interest of the public, the bar, and the courts for the latter to be suspended from the practice of law in the Commonwealth of Pennsylvania pending the conclusion of ODC’s investigation and further proceedings to determine the extent of final discipline.
The Pennsylvania Supreme Court approved the joint petition for emergency temporary suspension of Weinstein.
The Disposition states:
“AND NOW, this 14th day of July 2023, the Joint Petition for Emergency Temporary Suspension is granted, and Yale Darran Weinstein is placed on immediate temporary suspension until further definitive action by this Court. See Pa.R.D.E. It is further provided that:
1. Respondent shall comply with the provisions of Pa.R.D.E. 217;
2. The President Judge of the Court of Common Pleas of Chester County shall enter such orders as may be necessary to protect the rights of Respondent’s clients or fiduciary entities with which he is involved, see Pa.R.D.E. 217(g); and
3. All financial institutions in which Respondent holds fiduciary funds shall freeze such accounts pending further action.
