On Friday, March 8, 2024, the Board of Immigration Appeals reinstated Arizona attorney Jose Luis Chaidez to practice law before the Department of Homeland Security and Immigration Courts.

The case is entitled “In the Matter of Jose Luis Chaidez.”

Chaidez had been suspended from practicing law in both Arizona courts and federal immigration agencies. According to court documents, Chaidez agreed in November 2023 to resolve two counts of alleged ethics violations related to his representation of clients. He conditionally admitted to violations of Arizona rules. As part of the agreement, Chaidez was suspended from practicing law for 60 days starting in November 2023. He was also placed on probation for two years.

On January 22, 2024, the Presiding Disciplinary Judge of the Arizona Supreme Court issued an order reinstating Chaidez to the active practice of law in Arizona. This followed Chaidez serving the 60-day suspension period.

In their March 8 order, the Board of Immigration Appeals reinstated Chaidez’s ability to practice before federal immigration agencies, noting he had provided evidence of being authorized again to practice law in Arizona. The disciplinary counsel for the immigration courts and Department of Homeland Security did not dispute that Chaidez met the requirements to be reinstated as an attorney under federal regulations.

The Disposition states:

“ORDER: The respondent is reinstated to practice before EOIR and DHS, as of the date of this order.”

According to Avvo, Mr. Chaidez is a criminal defense attorney in Phoenix, Arizona. He attended the Thomas M. Cooley. He acquired his law license in Arizona in 2007.
