On Wednesday, August 9, 2023, a significant ruling was handed down by the Supreme Court of the State of New York Appellate Division; Second Judicial Department. In a landmark decision, attorney Jamie Burke was disbarred after pleading guilty to grand larceny, marking a significant blow to his legal career and reputation.

The case is entitled “In the Matter of Jamie Burke,” with case no. 2023-04027.

The decision follows Burke’s guilty plea to felony charges, prompting the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts to file a motion to strike her name from the roll of attorneys and counselors-at-law. This action was taken in accordance with Judiciary Law § 90(4)(b), which pertains to disbarment based on a felony conviction.

Burke faced charges of grand larceny in the third degree and petit larceny, a class A misdemeanor. On February 2, 2023, she entered a guilty plea for these offenses. Despite being served with the motion, Burke chose not to contest it or provide a response. Under Judiciary Law § 90(4)(a), the automatic disbarment of an attorney upon conviction of a felony came into effect. Consequently, the motion to strike Burke’s name from the list of attorneys was granted by the court. Her disbarment was effective from February 2, 2023, the date of her felony conviction.

As a result of this decision, Burke is now obligated to cease practicing law in any capacity, including appearing as an attorney before courts or public authorities, giving legal opinions or advice, and holding herself out as an attorney. Additionally, she is required to comply with the rules and regulations governing disbarred or suspended attorneys.

The Disposition states:

“Pursuant to Judiciary Law 90(4)(a), the respondent was automatically disbarred and ceased to be an attorney upon her conviction of a felony. Accordingly, the motion to strike the respondent’s name from the roll of attorneys and counselors-at-law, pursuant to Judiciary Law 90(4)(b), is granted to reflect the respondent’s automatic disbarment as of February 2, 2023.”

Before her disbarment, Ms. Burke practiced in Brooklyn, New York, and held a valid license in the state. Her info can be found on avvo.com.
