On Friday, February 2, 2024, the Supreme Court of California issued an order summarily disbarring attorney Troy Xavier Kelley. The order stemmed from a request for summary disbarment filed by the State Bar of California’s Office of Chief Trial Counsel on July 19, 2023.

The case is entitled “In the Matter of Troy Xavier Kelley,” with case no. S282317.

According to the memorandum of points and authorities submitted by the State Bar, Kelley suffered several felony convictions in 2017 in federal court for offenses that involved moral turpitude, including possession of stolen property, making false declarations, and filing false tax returns.

The memorandum detailed that Kelley’s convictions arose from conduct whereby he stole over $1.4 million in unused reconveyance fees that should have been refunded to borrowers through his business, Post Closing Department, which provided reconveyance tracking services to title companies. Kelley lied to the title companies, claiming he would properly administer the fees when in fact he retained and converted the funds for his own personal use. He later attempted to conceal the funds and lie about his actions in related civil litigation and under oath.

The State Bar argued that Kelley’s convictions met the requirements for summary disbarment under the California Business and Professions Code because the offenses were felonies and involved moral turpitude or the specific intent to deceive. As the convictions were final, having been upheld through direct appeals and post-conviction challenges, the State Bar contended Kelley was not entitled to a hearing and recommended his prompt disbarment pursuant to the summary procedure.

On January 24, 2024 order, the California Supreme Court denied Kelley’s petition for review of the recommendation. It then ordered that Kelley be summarily disbarred from practicing law in California and that his name be stricken from the roll of attorneys. The order also awarded costs to the State Bar to be collected as a money judgment.

According to apps.callbar.ca.gov, Mr. Kelley acquired his law license in California in 1990.
