On Wednesday, February 7, 2024, the Supreme Court of California issued an order disbarring attorney Richard Anthony LaCava from the practice of law in the state.

The case is entitled “In the Matter of Richard Anthony LaCava,” with case no. S282888.

According to court filings, LaCava failed to properly respond to formal disciplinary charges issued against him by the State Bar in March 2023. He did not file an answer to the Notice of Disciplinary Charges within the required 20-day period.

As a result, LaCava faced entry of default by the State Bar Court in May 2023. He was notified that failure to have the default set aside or vacated could lead to a recommended disbarment without further proceedings. However, LaCava did not file a motion to set aside or vacate the default by the August 2023 deadline.

This prompted the State Bar to file a Petition for Disbarment After Default in the State Bar Court in August 2023. The petition demonstrated that LaCava had been properly served with notice of the disciplinary proceedings. It also noted that the factual allegations in the Notice of Disciplinary Charges, which were deemed admitted due to the default, supported findings that LaCava had violated rules that warranted discipline.

With LaCava taking no action to respond to the default or petition, the State Bar Court recommended his disbarment to the Supreme Court. Finally, on February 7, 2024, the Supreme Court issued the disbarment order against LaCava formally removing him from the practice of law in California. He is required to comply with notification and winding down requirements within the next 30-40 days. The order also assesses $5,000 in monetary sanctions against LaCava.

The Disposition states:

“The court orders that Richard Anthony LaCava (Respondent), State Bar Number 135653, is disbarred from the practice of law in California and that Respondent’s name is stricken from the roll of attorneys.”

According to avvo.com, Mr. LaCava was a bankruptcy & debt attorney in San Francisco, California. He acquired his law license in California in 1988.
