One key condition of Garcia’s probation is an actual suspension from practicing law for the first 18 months. In addition to the suspension and probation, Garcia must comply with other requirements recommended by the State Bar Court. He is required to take and pass the Multistate Professional Responsibility Examination (MPRE) and provide proof of passage to the State Bar’s Office of Case Management and Supervision (OCMS). Failure to comply with this requirement may result in further suspension.

The court also ordered Garcia to pay monetary sanctions amounting to $500 to the State Bar of California Client Security Fund. This payment must be made in accordance with Business and Professions Code section 6086.13 and rule 5.137 of the Rules of Procedure of the State Bar. The monetary sanctions are enforceable as a money judgment and may be collected through any means permitted by law.

The Supreme Court’s order also stipulates that Garcia must cover the costs associated with the disciplinary proceedings. These costs are awarded to the State Bar in accordance with Business and Professions Code section 6086.10 and are enforceable under section 6140.7 of the same code, also as a money judgment.
