On Wednesday, February 1, 2023, the Chief Justice of the Supreme Court of California ruled on the disciplinary charges against Oakhurst attorney John Robert Waterman for a criminal conviction involving misconduct.

The case is styled “In the Matter of John Robert Waterman’ with case no. 22-C-30436.

According to the court document, Mr. Waterman has been found guilty of a misdemeanor for driving while intoxicated (BAC 0.08 or higher), which may or may not have involved moral turpitude. The case of Mr. Waterman was referred to the Hearing Department for a determination of whether the facts and circumstances surrounding the violation for which Mr. Waterman was convicted involved moral turpitude or other misconduct warranting discipline, and, if so, the discipline to be imposed. This is because the judgment of conviction is final and no grounds for interim suspension appear on the record of conviction.

On October 18, 2022, the parties filed a stipulation which was approved by the Hearing Committee.

Based on the foregoing facts, the Court ruled against the respondent and entered an order suspending Mr. Waterman with conditions.

The disposition reads:

“The court orders that John Robert Waterman (Respondent), State Bar Number 215378, is suspended from the practice of law in California for one year, execution of that period of suspension is stayed, and Respondent is placed on probation for one year subject to the following conditions:

    1. Respondent is suspended from the practice of law for the first 30 days of probation.
    2. Respondent must comply with the other conditions of probation recommended by the Hearing Department of the State Bar COurt in its Order Approving Stipulation filed on October 18, 2022; and
    3. At the expiration of the period of probation, if Respondent has complied with all conditions of probation, the period of stayed suspension will be satisfied and that suspension will be terminated.”

Waterman is also ordered to pay monetary sanctions to the State Bar of California Client Security Fund in the amount of $2,500.
