On Tuesday, June 6, 2023, the State of Minnesota Supreme Court suspended attorney Donald B. Nemer for committing professional misconduct warranting public discipline.

The case is entitled “In the Matter of Donald B. Nemer,” and was brought by the Office of Lawyers Professional Responsibility with case no. A22-1836.

The respondent has found himself at the center of disciplinary proceedings following allegations of professional misconduct. The Director of the Office of Lawyers Professional Responsibility filed a petition outlining multiple charges against Nemer, resulting in a recommended suspension and probation.

The petition asserts that Nemer failed to fulfill his professional obligations in various instances. These include improper documentation of a cash payment from a client, inadequate demonstration of thoroughness, preparedness, and legal knowledge during representation, lack of diligence in representing the client, and failure to maintain effective communication that caused unnecessary delays in case proceedings. Moreover, Nemer is accused of knowingly disregarding court instructions and providing false and misleading statements to the court. In a separate matter, he allegedly failed to clearly communicate fee agreements and improperly split legal fees with a lawyer not affiliated with his firm.

As a result of the disciplinary proceedings, Nemer and the Director reached a stipulation for discipline, in which Nemer waives his right to respond and admitted to all allegations unconditionally. The recommended disciplinary action entails a 90-day suspension from practicing law, followed by two years of probation. Nemer is expected to comply with the court’s orders, including paying costs, adhering to rules governing suspension notices, and fulfilling reinstatement conditions. Additionally, during his probation period, he must abide by the Minnesota Rules of Professional Conduct and cooperate fully with the Director’s Office. Failure to meet these requirements may result in further disciplinary action or automatic suspension.

The Disposition states:

“IT IS HEREBY ORDERED THAT: 1. Respondent Donald B. Nemer is suspended from the practice of law for a minimum of 90 days, effective 14 days from the date of this order.”

Mr. Nemer practices in Edina, Minnesota. He is licensed in Minnesota. His info can be found on avvo.com.
