On Tuesday, July 25, 2023, the Indiana Supreme Court accepted Elkhart attorney Rachel A. Kidd’s resignation from the state bar amidst ongoing proceedings involving accusations of misconduct.

The case is entitled “In the Matters of Rachel A. Kidd,” case nos. 22S-DI-157 and 23S-DI-46.

Kidd submitted an affidavit seeking to resign from the bar in accordance with Indiana Admission and Discipline Rule 23(17), which requires an acknowledgment of a pending investigation or proceeding involving allegations of misconduct for which she could not successfully defend herself.

Kidd’s resignation came in after a complaint filed in February 2023 alleging misconduct in her representation of a woman in a bankruptcy proceeding by failing to make necessary filings and failing to respond to the client’s request for information.

Kidd was also the subject of a 20-page Disciplinary Complaint filed by the Disciplinary Commission on May 19, 2022, containing nine counts of misconduct alleging Kidd of failure to file bankruptcy paperwork on behalf of a client, failure to refund attorney and filing fees, and failure to communicate to client’s request for information. Kidd was further alleged to have failed to diligently pursue a client’s interest and failed to explain a matter to said client to permit the latter to make informed decisions regarding the representation. Moreover, Kidd was alleged of commingling client funds with her personal funds and failing to properly safe-keep her clients’ funds.

The Supreme Court of Indiana agreed to Kidd’s resignation from the state bar. The Court also ruled that any attorney disciplinary proceedings about Kidd were no longer valid and ended them because of Kidd’s resignation.

Kidd will not be eligible to seek reinstatement to the practice of law in Indiana for five years from the date of the order.

Ms. Rachel A. Kidd earned a law degree from Indiana University School of Law, graduating in 1995. She maintained her law practice in Elkhart, prior to her resignation. Kidd had been admitted to practice in Indiana in 2022, license no. 23827-53. Her info can be found on Avvo.com.
