On Monday, January 22, 2024, the Florida Bar petitioned the Supreme Court of Florida for approval of a Conditional Guilty Plea from attorney Joshua Theodore Mosley related to two disciplinary matters.
The case is entitled “The Florida Bar v. Joshua Theodore Mosley,” with case number 2023-30,223 (19A).
According to the filings, Mosley has been practicing law in Florida since 2012 and is currently the subject of Bar File Nos. 2023-30,223 and 2023-30,727. The filings allege Mosley violated professional conduct rules through multiple criminal acts, including two instances of driving under the influence in 2022 and 2023.
On August 22, 2022, Mosley was arrested for DUI and later pled no contest to reckless driving with adjudication withheld. He was placed on probation for 364 days. On June 17, 2023, Mosley was again arrested for DUI along with other charges. He later pled no contest to DUI with property damage and refusal to submit to a chemical test.
Through the Conditional Guilty Plea, Mosley admits to violating Rules Regulating the Florida Bar, including committing criminal acts reflecting adversely on his fitness as a lawyer. He agrees to a 10-day suspension from practice, three years probation with conditions like continuing rehabilitation and paying monthly monitoring fees, and elimination of references to his status as an attorney.
The Florida Bar petition seeks the Supreme Court’s approval of this Plea. If approved, Mosley would receive the agreed-upon discipline and be required to pay $1,250 in Bar costs. He acknowledges this Plea is binding only if finally approved by the Court.
The filings detail aggravating and mitigating factors. They note Mosley’s substantial experience practicing but no prior discipline record, lack of dishonest motive, personal problems, cooperation, and imposition of other penalties. The Plea complies fully with disciplinary rules, according to both Mosley’s counsel and Bar Counsel. The Court will consider whether to accept the Conditional Guilty Plea in this attorney discipline matter.
The Petition states:
“WHEREFORE, The Florida Bar respectfully requests that the Conditional Guilty Plea for Consent Judgment be accepted, the proposed discipline be imposed, and the Bar be awarded costs.”
According to avvo.com, Mr. Mosley is a criminal defense attorney in St Petersburg, Florida. He attended the University of Miami School of Law, graduating in 2012. He acquired his law license in Florida in the same year.
