On Monday, October 16, 2023, the Florida Bar filed a complaint in the Supreme Court of Florida against Attorney John Arthur Leklem for allegedly failing to provide competent and diligent representation to his clients in a condominium association election dispute. , Mr. Jose Rosario-Lozano and his wife, Priscilla Rivera Miranda,

According to the complaint, Leklem represented Jose Rosario-Lozano and his wife Priscilla Rivera Miranda in trying to contest the election process for their condominium association. Rosario-Lozano had been deprived of a potential position on the board of directors in an election held on May 26, 2021.

Leklem was hired on July 16, 2021, to file a petition for mandatory non-binding arbitration with the state Department of Business and Professional Regulation by the July 26 deadline. Rosario-Lozano paid Leklem a $3,000 fee.

However, Leklem did not file the petition by the deadline. He told Rosario-Lozano he would file it by July 19th, then July 22, but still did not submit it until July 24 via two-day express mail.

The petition was not received by the department until July 28, well past the deadline. It was dismissed on August 4 for being untimely. Leklem claims he never received the dismissal order because it was mailed to an old address of his.

After being hired, Leklem failed to adequately communicate with Rosario-Lozano about the status of the case, according to the complaint. When asked for updates, Leklem said the filing was pending but did not verify this with the department.

Rosario-Lozano learned of the dismissal from the department directly on November 18, 2021, after repeatedly trying to contact Leklem. Leklem also declined to refund any portion of the $3,000 fee.

The Florida Bar is now seeking discipline against Leklem for alleged violations of rules regarding competent representation, due diligence, and keeping a client reasonably informed. A response from Leklem to the complaint is mandatory under bar rules.

The request states:

“WHEREFORE, The Florida Bar prays respondent will be appropriately disciplined in accordance with the provisions of the Rules Regulating The Florida Bar as amended.”

According to avvo.com, Mr. Leklem is a litigation attorney in Orlando, Florida. He graduated from Ohio Northern University’s Claude W. Pettit College of Law in 1976 and obtained his law license in Florida the same year.
