On Thursday, August 24, 2023, the Supreme Court of Florida reprimanded attorney Marc S. Reiner for conducting unscheduled stops during supervised meetings while representing a client who was under pretrial supervision with a GPS ankle monitor.
The case is entitled “In the Matter of Marc S. Reiner,” and was brought by the Florida Bar with case no. SC2023-0387.
The charges cited Rules Regulating the Florida Bar 3-4.3, 4-1.1, and 4-8.4(a)(d).
Attorney Marc S. Reiner was recommended for disciplinary action by the Florida Bar following allegations of professional misconduct. The decision came after a comprehensive review of the case by a designated referee. The complaint against Reiner was filed on March 17, 2023, by The Florida Bar, citing instances of misconduct during his representation of client Alicia Mattson in several criminal matters. Ms. Mattson, who had been under pretrial supervision with a GPS ankle monitor, faced complications when Reiner made unauthorized stops during supervised meetings.
The report of the referee states:
“The respondent operated under the mistaken impression that the additional stops were authorized and permissible.”
The subsequent violation report had led to Ms. Mattson’s incarceration, prompting a hearing where Reiner failed to adequately address the unauthorized stops, further complicating the matter. The referee, in his report, recommended that Reiner be found guilty of violating specific Rules Regulating The Florida Bar, including rules related to misconduct and competence.
As per the referee’s recommendations, Reiner was set to face the following disciplinary measures: A public reprimand by publication; mandatory attendance at The Florida Bar’s Professionalism Workshop within the next six months; participation in the next scheduled Florida Bar Board Certification Review Course for Criminal Law; and payment of all associated disciplinary costs.
In its order, the Supreme Court approved the uncontested referee’s report and reprimanded Reiner. The respondent must attend The Florida Bar’s Professionalism Workshop and comply with all terms and conditions outlined in the report and consent judgment.
