On Thursday, April 13, 2023, the Board of the Professional Responsibility of the Supreme Court of Tennessee publicly censured attorney Edward Kendall White. The case is entitled “In the Matter of Edward Kendall White,” with case no. 68987c-6-ES and 68907c-6-ES.

The charges cited Tennessee Rules of Professional Conduct 1.1, 1.3, 3.4, and 8.4. 

Allegedly, in two representation matters, the respondent failed to comply with the procedures and failed to timely file the transcript or statement of evidence as required by the Tennessee Rules of Appellate Procedure.

The Release of Information states:

“In one client matter, Mr. White represented three indigent criminal defendants for whom he needed the services of an expert witness. Mr. White called the Administrative Office of the Court about approval for the cost of the expert, but he did not submit a motion for approval of the costs to the director in writing as set forth in Tennessee Supreme Court Rule 13, Section 5(e). The expert witness completed her work which was favorable for Mr. White’s clients. The expert submitted her invoice for payment, but it was denied by the Administrative Office of the Court because of Mr. White’s failure to comply with the procedure.”

The Release of Information continues:

“In another client matter, Mr. White represented a criminal defendant on appeal, and he failed to timely file the transcript or statement of evidence as required by the Tennessee Rules of Appellate Procedure. Mr. White later withdrew from the representation prior to submission of the transcript or statement of the evidence.”

In relation to these events, the Supreme Court of Tennessee Board of Professional Responsibility decided to publicly censure the respondent.

The order states:

“By the aforementioned acts, Edward Kendall White is in violation of Rules of Professional Conduct 1.1 (competence), 1.3 (diligence), 3.4 (fairness to opposing party and court), and 8.4(d) (prejudice to the administration of justice) and is hereby Publicly Censured for this violation.”
