On Tuesday, June 4, 2024, NBC News reported that a Georgia appeals court set an October hearing on efforts to remove the district attorney prosecuting former President Donald Trump.
The Georgia Appeals Court will hear arguments on October 4th regarding Trump’s continued legal push to disqualify Fulton County District Attorney Fani Willis from overseeing the case against him related to alleged attempts to overturn the 2020 election results. Trump’s lawyers must submit briefs supporting their position within 20 days.
The appeals process stems from a March ruling by Fulton County Superior Court Judge Scott McAfee who allowed Willis to remain the prosecutor, despite acknowledging lapses in judgment after she previously disclosed a romantic relationship with special prosecutor Nathan Wade, who she hired to assist on the Trump case.
While Judge McAfee said neither Willis nor Wade having direct financial stakes meant there was no “actual conflict,” he said it was a “tremendous lapse in judgment” and “unprofessional.” Wade later resigned from the case.
Trump and 18 others have been criminally charged by Willis’ office with state racketeering related to alleged schemes to pressure officials and members of Congress to undo now-President Biden’s Georgia win. Four alleged co-conspirators have pleaded guilty in cooperation deals, while the remaining defendants including Trump have entered not guilty pleas.
The October appeals hearing gives Trump’s legal team a chance to argue why Willis should be removed over alleged improper conduct. However, the prosecution will continue amid the appeals process unless a higher court intervenes. A removal of Willis would likely terminate the case against the former president.
