On Thursday, September 1, 2022, the Louisiana Attorney Disciplinary Board Hearing Committee #54 filed with the Louisiana Attorney Disciplinary Board its Report dated August 29, 2022, relating to the charges for attorney discipline against Gretna lawyer Juan Carlos Labadie for engaging in criminal conduct.

The case is titled, In Re: Juan Carlos Labadie, Case #22-DB-004.

The charges cited Labadie’s violation of the Louisiana Rules of Professional Conduct specifically Rule 8.4(a) and (b), which state:

It is professional misconduct for a lawyer to:

violate or attempt to violate the Rules of Professional Conduct, knowingly assist or induce another to do so, or do so through the acts of another;

commit a criminal act especially one that reflects adversely on the lawyer’s honesty, trustworthiness or fitness as a lawyer in other respects.

“On March 8, 2018, Respondent was arrested by Detective Weibelt of the Jefferson Parish Sheriff’s Office after the latter’s search, pursuant to a vehicle stop due to Respondent’s traffic violation, revealed that Respondent was in a possession of a substance which was tested and determined to be a cocaine. Respondent was booked shortly thereafter.”

According to the filing:

“The Committee reviewed the exhibits submitted by ODC, which are Exhibits ODC 1-7. Respondent did not submit evidence or argument for the Committee’s consideration, nor did he request to be heard in mitigation pursuant to Rule XIX, §11(E)(4).”

The filing continues:

“Respondent, by engaging in criminal misconduct, has violated Louisiana Rules of Professional Conduct Rule 8.4(a)(b).”

The Committee, in its Conclusion, recommended for Respondent’s suspension from the practice of law for two years, to run prospectively from the date of the final order of the Louisiana Supreme Court in this matter, and for respondent to pay costs and expenses of this proceeding.
