On Thursday, January 19, 2023, the U.S. Department of Justice Executive Office for Immigration Review Board of Immigration Appeals denied the petition for reinstatement of attorney Eduardo F. Justo De Pomar.
The case is entitled “In the Matter of Eduardo F. Justo De Pomar” and was brought by the Disciplinary Counsel for the Executive Office for Immigration Review and the Disciplinary Counsel for DHS with case no. D2022-0084.
On August 29, 2022, the U.S. Department of Justice Executive Office for Immigration Review Board of Immigration Appeals suspended the respondent from the practice of law for five months before the Board of Immigration Appeals, the Immigration Courts, and DHS based on the respondent’s earlier suspension from the District of Columbia.
After such suspension, the respondent filed a motion seeking reinstatement on November 9, 2022. The Disciplinary Counsel for the Executive Office for Immigration Review and the Disciplinary Counsel for DHS opposed the petition. According to the Disciplinary Counsel, they denied the petition for reinstatement on the ground that the respondent didn’t comply with the terms of his suspension. In support of such a claim, the Disciplinary Counsel submitted evidence showing that the respondent filed a Notice of Entry of Appearance (Form G-28) and a benefit request with the U.S. Citizenship and Immigration Services (USCIS) on behalf of a client on November 7, 2022.
Board stated that the evidence submitted by the Disciplinary Counsel already established that the respondent did not comply with the Board’s suspension order. The respondent doesn’t deny such an allegation and actually discloses that he prematurely filed the USCIS Form G-28s that named him as counsel in seven applications while he was still under the suspension order. Considering all these facts and the admittance of the respondent, the Board denied his petition.
