On Friday, February 2, 2024, the Supreme Court of Hawaii granted attorney John Matthew Schum’s petition for reinstatement to the practice of law after serving a 60-day suspension the previous year stemming from misconduct in California involving impersonation and fraudulent misrepresentation.

The case is entitled “Office of Disciplinary Counsel vs. John Matthew Schum,” with case no. SCAD-23-0000254.

According to records from the case, Schum had been suspended by the court in September 2023 related to misconduct in California in 2022 when he improperly impersonated another individual without consent and fraudulently misrepresented them to cancel their bank accounts.

On February 24, 2023, the Supreme Court of California suspended Schum’s law license for misconduct in California involving improperly obtaining a person’s private information like their social security number and phone number, which Schum then used to cancel the individual’s bank accounts at Comerica without authorization, posing as the person.

As a result of Schum’s impersonation and unauthorized access to their accounts, the affected individuals faced financial hardship, having no access to their money for around three weeks until new cards were issued. They filed a police report over the incident, though criminal charges were not pursued due to the statute of limitations expiring.

While not directly connected to his legal work, Schum’s deceptive conduct in California was found to involve moral turpitude. This led to the one-year suspension in that state, with 60 days to actively serve and the remainder stayed pending one year of probation.

After fulfilling the suspension terms in Hawaii, Schum filed a December 2023 petition for reinstatement. With no objection from the Office of Disciplinary Counsel, the Hawaii Supreme Court reinstated his license on February 2, 2024, based on complying with the previous order. Schum will remain on probation in Hawaii for one year under the same terms set in 2023.
