On Thursday, September 21, 2023, the Supreme Court of Illinois ordered the removal of attorney Cory E. McGinn’s name from the roll of attorneys licensed to practice law in the state, effective immediately. This decision was made in response to McGinn’s motion to strike his name from the roll pursuant to Supreme Court Rule 762(a).
The case is entitled “In the Matter of Cory E. McGinn,” with case no. 031854.
On July 17, 2023, the Supreme Court of Illinois received a petition from Jerome Larkin, the administrator of the Attorney Registration and Disciplinary Commission (ARDC), against McGinn. The petition was filed pursuant to Supreme Court Rule 762(a) and contained a statement of charges against McGinn. According to the statement of charges, beginning in 2020, McGinn allegedly delayed payments to lienholders and clients after receiving settlement proceeds in 26 cases. He intentionally withdrew funds from the Chase IOLTA account by transferring money to other accounts or making withdrawals for his own purposes. As a result, by September 30, 2022, McGinn had drawn the balance in the Chase IOLTA account down to $2,450.64 from $109,292.22, which should have been held for clients or their lienholders.
McGinn used at least $106,841.58 of the clients’ or third-party funds for his own business or personal purposes without authority, constituting conversion. He violated the Illinois Rules of Professional Conduct by failing to hold clients’ or third-party funds separate from his own property. He also failed to promptly deliver funds that clients or third parties were entitled to receive.
After considering McGinn’s motion to strike his name from the roll and the statement of charges, the Supreme Court decided to remove McGinn’s name from the list of licensed attorneys in the state,
The Disposition states:
