On Thursday, August 24, 2023, the Indiana Supreme Court accepted attorney Amanda R. German’s resignation from the state bar amidst continuing proceedings linked to allegations of non-cooperation.

The case is entitled “In the Matter of Amanda R. German,” with case no. 23S-DI-231.

On November 15, 2022,  the Indiana Supreme Court suspended German from the practice of law for non-cooperation. The legal proceedings commenced on September 7, 2022, when the court issued an order for German to demonstrate why she should not face immediate suspension from practicing law in the state. This directive came after German’s alleged failure to cooperate with an investigation by the commission into a grievance filed against her. Despite the court’s stipulation that German respond within 10 days of being served, no such response was submitted.

However, a pivotal shift occurred on November 16, 2022, when the Executive Director of the Disciplinary Commission reported that German had begun to cooperate with the investigation. This led to the Indiana Supreme Court issuing an order terminating German’s suspension, effectively reinstating her to the practice of law.

Following this event, German submitted an affidavit of resignation to the Court in accordance with Indiana Admission and Discipline Rule 23(17). This rule mandates an acknowledgment that there is an ongoing investigation or proceeding regarding alleged misconduct, and Germany believes she couldn’t mount a successful defense if prosecuted.

In response, the Supreme Court of Indiana accepted to German’s resignation from the State Bar. The court also dismissed the attorney disciplinary proceedings against the German as moot following her resignation. German will not be eligible to seek reinstatement to the practice of law in Indiana for five years from the date of the order.

The Disposition states:

“IT IS THEREFORE ORDERED that the resignation from the bar of this State tendered by Respondent is accepted effective immediately. The Clerk of this Court is directed to record the Respondent’s resignation on the Roll of Attorneys. Respondent shall fulfill all the applicable duties under Admission and Discipline Rule 23(26).”
