On Thursday, January 26, 2023, the Supreme Court of Indiana ruled on the Affidavit of Resignation from the state Bar filed by Gary attorney Eric O. Clark.
The case is styled as “In the Matter of Eric O. Clark,” case no. 22S-DI-376.
Clark, in a disciplinary complaint filed on November 9, 2022, was alleged to have hugged, kissed, and solicited sexual favors from a potential client in exchange for a discount on Clark’s attorney fees. The complaint further alleged that later on Clark offered to represent the client for free if she did not report his misconduct.
Clark filed an Affidavit of Resignation, acknowledging that the allegations are true and that he could not successfully defend himself if prosecuted.
Accordingly, the Court found Clark’s admitted misconduct as egregious and a flagrant abuse of his position, ruled against Clark, and entered a Published Order Accepting Resignation and Concluding Proceeding.
The disposition reads:
“IT IS THEREFORE ORDERED that the resignation from the bar of this State tendered by Respondent is accepted effective immediately.”
The Order further stated that any disciplinary proceedings pending against Clark are dismissed as moot as a result of Clark’s resignation. Moreover, the Court’s acceptance of Clark’s resignation does not relieve Clark from any liability he might have for his misconduct under civil or criminal law.
Costs were taxed against Clark.
Prior to his resignation, Mr. Eric Oden Clark practiced in Gary, Indiana. He had been licensed in Indiana.
