On Thursday, March 30, 2023, the Indiana Supreme Court ruled on the Disciplinary Commission’s motion seeking to correct an erroneously entered suspension order concerning attorney J. David Massey.

The case is styled ‘In the Matter of J. David Massey,’ case #21S-DI-388.

According to the Published Order, the Court entered an Order on November 16, 2021, suspending Massey for failure to cooperate with the Commission in relation to a grievance, No. 21-1068. Also, on March 31, 2022, the Court indefinitely suspended Massey, in response to the Commission’s motion converting the noncooperation suspension to an indefinite suspension.

The filing states:

“The Commission now has filed a “Motion to Correct Erroneously Entered Suspension Order.” In sum, the motion indicates that the grievant had not intended to file the grievance against Respondent but rather against another attorney with a similar name.”

In light of the foregoing facts and having been duly advised, the Court granted the Commission’s motion.

The disposition reads:

“The suspension orders issued in this case on November 16, 2021, and March 31, 2022, are hereby VACATED. Respondent’s suspension ordered in one or more other cases remains in effect, and Respondent shall not be shown as reinstated to the practice of law in this state until all causes for suspension are cured.”
