On Thursday, February 19, 2026, the Supreme Court of Kentucky suspended attorney Scott White from the practice of law for thirty days, effective upon the entry of the order. This decision stems from White’s failure to adhere to the terms of a negotiated sanction previously issued on December 19, 2024.

The case is entitled “In the Matter of Scott White,” with case no. 2024-SC-0489-KB.

The Court determined that White violated the earlier agreement by not providing an accounting or refunding an unearned prepaid fee to his former client, Justin Tomey, and failing to provide proof of said refund to the Office of Bar Counsel.

Additionally, White had been suspended from practicing law on March 21, 2025, due to unpaid bar dues, which was another condition of his prior sanction. The Office of Bar Counsel initiated a show cause motion on August 18, 2025, to which White did not respond.

The new order imposes several conditions on White. Beyond the 30-day suspension, he must continue complying with Kentucky Lawyer Assistance Program (KYLAP) recommendations and provide quarterly updates to the Office of Bar Counsel. He is also required to authorize the Bar Counsel to access his KYLAP, mental health, and medical records.

Within 30 days, White must provide an accounting and refund any unearned portion of the fee to Justin Tomey, along with proof of refund. The order further mandates that he incur no new disciplinary charges, timely pay his Kentucky Bar Association dues, satisfy all continuing legal education requirements, and pay certified disciplinary costs amounting to $534.89.

According to Avvo.com, Mr. White is a litigation attorney in Versailles, Kentucky. He acquired his law license in Kentucky in 1994.
