On January 12, 2024, the Grievance Commission of the Board of Overseers of the Bar of Maine publicly reprimanded attorney David M. Zirschky for misconduct.

The case is entitled “Board of Overseers of the Bar v. David M. Zirchsky,” with case no. GCF #22-214.

The case stemmed from complaints originally filed against Zirschky in August 2022 regarding incidents that had occurred on March 11, 2022. On that date, Zirschky allegedly provided inaccurate information during an encounter with a Maine Warden Service Officer. He was subsequently alleged to have failed to fully cooperate with the bar counsel’s investigation into the matter, which began in September 2022.

Specifically, when bar counsel requested supplemental documentation on September 2, 2022, and October 26, 2022, Zirschky did not provide all of the materials requested regarding his residential and licensing records. He also failed to submit proof of reporting a prior OAS for OUI conviction from Tennessee that had occurred in 2019, as required by Maine Bar Rule 23(a).

On July 18, 2023, during testimony before the Grievance Commission, Zirschky acknowledged that he had not notified bar counsel about the conviction as required. Rather than proceeding to a hearing on the formal charges, the parties negotiated a stipulated resolution, which was submitted to the Grievance Commission panel in advance of a hearing held on December 29, 2023.

Under the terms of the January 12, 2024 decision, Zirschky received a public reprimand and was ordered to complete three ethics CLE credits by July 12, 2024. The sanctions were deemed warranted given the misconduct involved violations of duties to the profession through potential violations of Maine Rules of Professional Conduct 8.1(b), 8.4(c), and 8.4(d) despite minor potential injury. The stipulation concluded the disciplinary case without the need for further proceedings.
