The Maine Supreme Judicial Court has taken a significant step in overseeing the management of deceased attorney Karen M. Burke’s law practice. In an order issued on August 2, 2023, the court has appointed Megan Hanle and Assistant Bar Counsel Audrey Braccio as co-receivers for the late attorney’s practice. The decision follows a petition submitted by the Board of Overseers of the Bar, highlighting the need for proper management of the legal affairs left behind by the deceased attorney.

The case is entitled “In the Matter of Karen M. Burke,” with case no. BAR-23.

The co-receivers have been granted comprehensive authority over various aspects of Karen Burke’s law practice. Effective immediately, they are tasked with responsibilities that include securing professional files, obtaining client funds, and managing all property associated with the law office, irrespective of its location. In addition to this, the co-receivers have the duty to access and acquire any computer hardware, software, and mobile devices used by Attorney Burke for business purposes.

Furthermore, the co-receivers are empowered to access email accounts, cloud storage, and other digital platforms used by Attorney Burke for business activities. They are also required to secure any physical mail by obtaining access to post office boxes linked to the law practice. As part of their mandate, the co-receivers will undertake the crucial task of inventorying client files, prioritizing open and active cases, and notifying former clients about the closure of the law practice.

The court’s order emphasized that the co-receivers’ role will be pro bono, ensuring that they serve in the interest of the legal community. However, if there are sufficient assets, including receivables, from Burke’s law practice, the co-receivers may be reimbursed for their efforts. It’s important to note that the co-receivers will also be responsible for reporting any disbursements made in the course of their duties, ensuring transparency and accountability in their actions.
