On Friday, July 28, 2023, the Supreme Court of Maryland granted the petition for reinstatement filed by attorney Brein M. Penn.
The case is titled “In the Matter of the Petition for Reinstatement of Brien M. Penn to the Bar of Maryland,” with case no. AG 76.
Brien M. Penn was disbarred on April 25, 2013, for conduct involving dishonesty and deceit against his employer by engaging in activities that violated rules 8.4(a), (c), and (d) of the Maryland Rules of Professional Conduct, which provide that:
It is professional misconduct for a lawyer to:
(a) violate or attempt to violate the Maryland Lawyers’ Rules of Professional Conduct, knowingly assist or induce another to do so, or do so through the acts of another;
(b) commit a criminal act that reflects adversely on the lawyer’s honesty, trustworthiness, or fitness as a lawyer in other respects;
(c) engage in conduct involving dishonesty, fraud, deceit or misrepresentation;
(d) engage in conduct that is prejudicial to the administration of justice.

Mr. Penn sought reinstatement to the Bar through a verified Petition. On consideration of the merits of the petition, the Court grants the petition and orders the reinstatement of the petitioner as a member of the Bar.
The order reads:
“Upon consideration of Brien M. Penn’sverified petition for reinstatement to the Bar of Maryland,andBar Counsel’sresponsetothe petition, it is this 28th day of July 2023, by theSupreme Court of Maryland
ORDERED that the petition is GRANTED;
and it is further ORDERED that Brien M. Pennis be reinstated as a member of the Bar of Maryland;
and it is further ORDERED that the Clerk of the Court shall replace the name Brien M. Pennuponthe register of attorneys entitled to practice law in this State and certify that fact to the trustees of the Client Protection Fund and the Clerks of all judicial tribunals in this State.”
