On Wednesday, June 5, 2024, attorney Albert J. Cimini received a three-month suspension from the practice of law, stayed for one year subject to conditions. According to a decision handed down by the Massachusetts Supreme Judicial Court, Cimini was found to have committed multiple violations of trust accounting rules and negligently misused client funds on two occasions.

Specifically, the Court document states that Cimini negligently used trust funds held for a client and intended to pay a subrogation lien for his own personal matters. He then also misused retainer funds from a second client to repay the first client’s insurer. Although Cimini had extensive experience as an attorney, aggravating his actions, the Hearing Committee had originally recommended a public reprimand along with submitting accurate financial records bi-monthly. However, the Board rejected this proposal, noting it would be difficult to enforce any imposed conditions.
Instead, the Board and subsequently the Court agreed on a three-month suspension stayed for one year, pending Cimini meets certain conditions. He must submit accurate financial quarterly records to the Office of Bar Counsel for review and approval, demonstrating compliance with trust accounting rules. If Cimini chooses to retire, he will also need to provide proof that all client accounts were properly closed. Provided he satisfies these terms, the stayed suspension will be lifted after a year.
