On Tuesday, August 15, 2023, the Commonwealth of Massachusetts Supreme Judicial Court entered an order allowing the Board of Bar Overseers to initiate the process of seeking reimbursement from attorney Benjamin Behnam Tariri.

The case is entitled “In the Matter of Benjamin Behnam Tariri,” with case no. BD-2022-080.

On May 25, 2023, the Massachusetts Supreme Judicial Court for Suffolk County ordered the temporary suspension of attorney Benjamin Behnam Tariri for misconduct including misuse of client funds. The case originated from Tariri’s diversion of substantial client funds, amounting to hundreds of thousands of dollars, to fuel his gambling addiction and settle personal debts. Tariri misallocated funds from his Interest in the Lawyer’s Trust Account (IOLTA account), diverting them for purchasing lottery tickets and covering other clients’ expenses. He further solicited loans from both current and former clients, issuing checks in repayment, which were later returned due to insufficient funds. Tariri not only defaulted on certain loans but also faced client complaints, prompting board involvement.

In connection with this matter, the Bar Counsel filed a motion on August 7, 2023, requesting the approval of the commissioner’s fees and expenses. The motion had asserted the reasonableness of the second interim report and invoice. The court granted the motion, thereby authorizing the disbursement of $11,625.00 to Attorney Roy J. Watson, who served as the Commissioner. Moreover, the Board of Bar Overseers had been given the authority to initiate the process of seeking reimbursement of the same amount from Tariri.

“It is FURTHER ORDERED that the Board is further authorized to seek reimbursement in the amount of $11, 625.00 from Benjamin Behnam Tari ri pursuant to Section 9 of this Court’s June 5, 2023, Order Appointing Commissioner and S. J.C. Rule 4:01, S 14.”
