On Friday, December 8, 2023, the Michigan Attorney Discipline Board Tri-County Hearing Panel #52 suspended Attorney Steven M. Gittleman for misconduct.

The case is titled ‘In the Matter of Steven M. Gittleman,’ with case no. 23-43-GA.

The cited disciplinary matter is linked to Attorney Gittlmen’s numerous violations of the Michigan Rules of Professional Conduct, specifically Rules 1.1(c), 1.2(a), 1.3, 1.4(a),  1.15, 1.15(d), 1.15(f), 1.15(g), 1.16(d), 8.4(c) and Michigan Court Rules 9.104(1), 9.104(2), and 9.104(3).

The Michigan Rules of Professional Conduct can be found here.

The suspension stems from Attorney Gittleman’s representations related to a probate matter and improper use of his client’s trust account. According to the consent order filed by Attorney Gittleman and the Grievance Administrator, Gittleman failed to properly handle client funds, complete the legal work promptly, and provide a refund as promised to his probate client. Additionally, Attorney Gittleman misused his client’s trust account by depositing personal funds above what was necessary to cover bank fees.

Attorney Gittleman admitted to the misconduct allegations regarding violations of Michigan Rules of Professional Conduct related to competence, diligence, communication with clients, properly safeguarding client property, and more. Based on these admissions, the hearing panel found Attorney Gittleman engaged in conduct prejudicial to the administration of justice, among other rule violations.

As a result of the stipulation reached between Attorney Gittleman and the Grievance Administrator, the hearing panel ordered Attorney Gittleman’s law license to be suspended for 179.

The disposition reads:

“In accordance with the stipulation of the parties, the hearing panel ordered that respondent’s license to practice law in Michigan be suspended for 179 days, effective December 1, 2023. The panel also ordered that respondent be subject to conditions relevant to the established misconduct and that he pay restitution in the amount of $1,030.00. Total costs assessed in the amount of $907.33.”
