On Wednesday, August 24, 2022, the State of Michigan Attorney Discipline Board issued an Amended Notice of Automatic Interim Suspension for Farmington attorney Jay A. Schwartz for his November 17, 2021 conviction on three felonies – conspiracy to defraud the United States, and two counts of bribery involving federal programs.
Schwartz’s conviction on the three felonies was in violation of 18 USC § 371 and 18 USC § 666(a)(2), which state:
Conspiracy to commit offense or to defraud the United States If two or more persons conspire either to commit any offense against the United States, or to defraud the United States, or any agency thereof in any manner or for any purpose, and one or more of such persons do any act to effect the object of the conspiracy, each shall be fined under this title or imprisoned not more than five years, or both.
If, however, the offense, the commission of which is the object of the conspiracy, is a misdemeanor only, the punishment for such conspiracy shall not exceed the maximum punishment provided for such misdemeanor.
Whoever, if the circumstance described in subsection corruptly gives, offers, or agrees to give anything of value to any person, with intent to influence or reward an agent of an organization or of a State, local or Indian tribal government, or any agency thereof, in connection with any business, transaction, or series of transactions of such organization, government, or agency involving anything of value of $5,000 or more; shall be fined under this title, imprisoned not more than 10 years, or both.
The Amended Notice of Automatic Interim Suspension, reads:
“Effective November 17, 2021
“In accordance with MCR9.120(B)(1), respondent’s license to practice law in Michigan was automatically suspended on the date of his felony conviction.”
“Upon the filing of a certified judgment of conviction, this matter will be assigned to a hearing panel for further proceedings. The interim suspension will remain in effect until the effective date of an order filed by a hearing panel.”
