On Wednesday, August 3, 2022, Minnesota Supreme Court ruled on charges for attorney discipline against attorney Brent E. Lindberg for violating the Rules of Professional Conduct.

According to the order, the Director of the Office of Lawyers Professional Responsibility filed a petition for disciplinary action seeking reciprocal discipline after Lindberg was publicly disciplined by the Kansas Supreme Court.

The order states:

“Respondent was disciplined in Kansas after an incident stemming from March 2018, resulted in the respondent being convicted of felony drug possession…. Respondent also failed to file an answer to the complaint, in violation of Kansas Supreme Court Rule 211(b). The Kansas Court imposed an indefinite suspension with no right to petition for reinstatement for three years.”

Both the Director and Lindberg agreed that reciprocal discipline should be applied, but recommended that the identical discipline would be substantially different from the discipline that would be imposed in Minnesota. They jointly recommended that the appropriate discipline is a 60-day suspension followed by two years of supervised probation.

The order concluded:

“The court has independently reviewed the file and approves the recommended disposition,

IT IS HEREBY ORDERED THAT:

1. The respondent is hereby suspended for 60 days, effective the date of this order, pursuant to Rule 15, RLPR;

2. The reinstatement hearing provided for in Rule 18(a) through (d), RLPR, is waived;

3. Respondent shall successfully complete the professional responsibility portion of the state bar examination within one year of the date of this Court’s order;

4. Respondent shall comply with Rule 26, RLPR;

5. Respondent shall pay $900 in costs pursuant to Rule 24(a), RLPR.”

Mr. Lindberg has been licensed in Minnesota, with license number #0235246, as well as in Kansas.
