The Minnesota Office of Lawyers Professional Responsibility has filed a petition with the Minnesota Supreme Court seeking disciplinary action against Thief River Falls attorney Anders L. Odegaard. The August 9, 2023 petition alleges Odegaard committed professional misconduct by pleading guilty to second-degree felony murder and failing to cooperate with the disciplinary investigation.

The case is entitled “In the Matter of Anders L. Odegaard,”

The charges cited Minnesota Rules of Professional Conduct 8.4(b), 8.1(b), and 25(a).

Odegaard was admitted to the Minnesota Bar in 2018 but is currently not practicing law. He is in custody at the Pennington County Jail after pleading guilty on July 7, 2023, to second-degree felony murder of his ex-wife. According to the petition, “Respondent was alleged to have murdered his ex-wife during an assault in front of the couple’s minor child.”

The petition states Odegaard was charged on August 31, 2022, with two counts of second-degree murder. On July 7, 2023, he entered an Alford plea to one count of second-degree felony murder in violation of Minn. Stat. § 609.19.2(1). This crime carries a maximum sentence of 40 years imprisonment.

The petition alleges Odegaard’s guilty plea violates Rule 8.4(b) of the Minnesota Rules of Professional Conduct, which prohibits lawyers from “commit[ing] a criminal act that reflects adversely on the lawyer’s honesty, trustworthiness, or fitness as a lawyer in other respects.”

Additionally, the petition accuses Odegaard of failing to cooperate with the disciplinary investigation in violation of professional rules. The Office of Lawyers Professional Responsibility sent Odegaard requests for information in August and November 2022, but he did not respond. The petition states this lack of cooperation violates rules requiring lawyers to respond to disciplinary authorities.

The Disposition states:

“WHEREFORE, the Director respectfully prays for an order of this Court disbarring respondent or imposing otherwise appropriate discipline, awarding costs and disbursements pursuant to the Rules on Lawyers Professional Responsibility, and for such other, further or different relief as may be just and proper.”
